The regular Town Board meeting, held at the Walworth Town Hall, 3600 Lorraine Drive, was called to order at 7:30 P.M. by Supervisor Frank Guelli. Board members present: Daniel Keyes, Frank Maciuska, Patti Marini and Thomas Yale. Other town employees present: Norman Druschel, Building Inspector Michael Frederes, Highway Superintendent Debora Germain, Recreation Director Richard Morris, Attorney for the Town Paul Russell, Town Engineer George Schaller, Sewer Superintendent Phil Williamson, Code Enforcement Officer Marcia Englert, Town Clerk
MINUTES:
Motion by Councilwoman Marini to approve the minutes of June 16, 2005 as presented. Seconded by Councilman Keyes and unanimously carried.
EAGLE SCOUT PROJECT:
William O’Brien stated that his Eagle Scout project is to conduct a Red Cross blood drive. He requested approval to hold the blood drive at the Walworth Town Hall on July 29, 2005 from 11:00 am to 4:00 pm. He stated that he will conduct a canned food drive at the same time, to benefit the Walworth Food Pantry.
MOTION: Motion by Councilman Yale authorizing William O’Brien to conduct a Red Cross blood drive at the Walworth Town Hall on Friday, July 29, 2005 from 11:00 am to 4:00 pm. Seconded by Councilwoman Marini. Roll call vote: Supervisor Guelli Aye Councilman Keyes Aye Councilman Maciuska Aye Councilwoman Marini Aye Councilman Yale Aye Motion carried.
FIREFIGHTERS’ SERVICE AWARD PROGRAM:
Frank Salvagni and Jeanne Forkeutis, from UBS Financial Services, were present to request that UBS continue to manage the Firemen’s Service Award Program. Mr. Salvagni stated that under the previous management team the current rate of return is averaging 5%. He further stated that upon his review he determined that “the suitability of investments, the shared class of investment for reduced cost and the asset allocation of the investments should be considered and acted upon.” Under his management team, which is more structured and formalized, he is projecting a 7-7.5% rate of return. He stated that although there are many individual businesses within the same organization that must maintain certain standards, the management of each is a personal preference.
PUBLIC PARTICIPATION:
1. LINCOLN ROAD DRAINAGE:
Bill Brookover, 5336 Lincoln Road, requested that the drainage ditch be cleaned out. A drainage problem resulted from the construction of houses across the street from his home. Consequently, he had to install a sump pump.
LIBRARY BOARD APPOINTMENT:
Motion by Councilman Yale to appoint Diana Timmerman as Library Trustee, replacing Joanna Lynch, for a term expiring 12/31/05. Seconded by Councilwoman Marini. Roll call vote: Supervisor Guelli Aye Councilman Keyes Aye Councilman Maciuska Aye Councilwoman Marini Aye Councilman Yale Aye Motion carried.
MACEDON LANDFILL LAWSUIT ATTORNEY HIRED:
Motion by Councilwoman Marini authorizing Harris Beach Attorneys at Law to represent the Town of Walworth in the Macedon Land Development Inc. litigation now pending in Federal District Court. Seconded by Councilman Keyes. Roll call vote: Supervisor Guelli Aye Councilman Keyes Aye Councilman Maciuska Aye Councilwoman Marini Aye Councilman Yale Aye Motion carried. It was noted that this lawsuit resulted from the Town’s alleged use of the Town of Macedon landfill between January 1, 1968 and December 1978.
SEWER EXTENSION: CANANDAIGUA ROAD:
Paul Russell submitted the Black Creek Sanitary Trunk Sewer Plan Report, including costs, to serve the south side of Route 441 (Walworth-Penfield Road) west of Canandaigua Road, north of the wetlands. A portion of the report is a follows: “The Report was prepared to provide a basic plan for development of a sanitary trunk sewer north of the Black Creek wetlands and south of NYS Rt. 441 to serve current and planned future development in this area of the Town. The objective of this study for a future trunk sewer is to provide a facility that will serve the entire area south ofthe drainage divide (an irregular east-west line north of which surface drainage is north to Lake Ontario; south of the line drainage is to the Erie Canal;) and north of the Black Creek wetlands. “The design of a trunk sewer facility begins with delineation of logical drainage areas. Areas south of the drainage divide will drain by gravity to the proposed trunk sewer (it is strongly preferred to plan for gravity flow of wastewater to the treatment facility and avoid pumping stations with their contingent maintenance problems and operating costs).”
Supervisor Guelli noted that he and Mr. Russell met with Margaret Churchill, Wayne County Industrial Development Agency, to request funding and were encouraged by her response.
NYS LAND PRESERVATION GRANT PROGRAM: APPRAISALS:
Supervisor Guelli stated that there are eight (8) farmland owners interested in seeking a grant.
MOTION: Motion by Councilman Maciuska authorizing the expenditure of up to $3,500 for the appraisal of 5-6 parcels, contingent upon the Landowner and County also entering into said agreement with the understanding that upon the sale of the development rights as part of the grant proposal the Landowner will reimburse the Town for their portion of the contract. NYS LAND PRESERVATION GRANT COMMITTEE:
Motion by Councilman Maciuska to establish a Farmland Preservation Committee to establish guidelines for selecting properties to be entered into the program. Seconded by Councilwoman Marini. Roll call vote: Supervisor Guelli Aye Councilman Keyes Abstain Councilman Maciuska Aye Councilwoman Marini Aye Councilman Yale Aye Motion carried.
FIREWORKS PERMIT:
Supervisor Guelli stated that there will be a fireworks display July 23, 2005 at Carey Lake. Bruce Carey will notify adjacent property owners.
RECREATION: 50TH ANNIVERSARY PROCLAMATION:
Councilman Maciuska offered the following resolution and moved its adoption, seconded by Councilman Yale to wit: WHEREAS the National Recreation and Park Association has designated July as Recreation and Parks Month; and WHEREAS parks, recreation activities, sports and leisure experiences provide opportunities for young people to live, grow and develop into contributing members of society; and WHEREAS parks and recreation agencies create lifelines and continue life experiences for older members of our community; and WHEREAS parks and recreation generate opportunities for people to come together and experience a sense of community through fun recreational pursuits; and WHEREAS park and recreation agencies provide outlets for physical activities, stress reducing experiences; socialization, and parks, playgrounds, ball fields, nature trails, and open spaces that make a community attractive and a desirable place to live, work, play and visit and contribute to our ongoing economic vitality; and WHEREAS parks, greenways and open space provide a welcome respite from our fast- paced, high-tech lifestyles while protecting and preserving our natural environment, nation and heritage; and WHEREAS parks and recreation agencies touch the lives of individuals, families, groups and the entire community, and positively impact upon the social, economic, health and environmental quality of our community; and WHEREAS it is of particular note that the Walworth Recreation Department is celebrating its 50th anniversary this year and has, therefore, provided recreational programs to Town residents for fifty years; NOW, THEREFORE BE IT RESOLVED that the Walworth Town Board proclaims the month of July Recreation and Parks Month and encourages all citizens to celebrate by participating in their choice of leisure activities. DRAINAGE PROJECTS APPROVED:
Motion by Councilman Maciuska authorizing the following drainage projects, as recommended by the Town Engineer, for a cost not to exceed $23,100: ¨ Blue line stream tributary: Pump Station to Stalker Road ¨ Blue line stream: Stalker Road to wetlands ¨ House area on Farmview Drive/Rolford Heights: Top of hill to Farmview Drive ¨ Drainage ditch: Wetlands to Hennessey Road & Route 350 ¨ Storm sewer outlet: Heatherbrook Drive ¨ Blue line ditch: east of Lincoln Seconded by Councilman Yale. Roll call vote: Supervisor Guelli Aye Councilman Keyes Aye Councilman Maciuska Aye Councilwoman Marini Aye Councilman Yale Aye Motion carried.
RECREATION: SOCCER SHIRTS PURCHASE:
Motion by Councilman Maciuska authorizing payment of $2,815.20, from line A7310.43, to Traveling Tees for the purchase of soccer shirts. Seconded by Councilman Yale. Roll call vote: Supervisor Guelli Aye Councilman Keyes Aye Councilman Maciuska Aye Councilwoman Marini Aye Councilman Yale Aye Motion carried.
DOLOMITE PARK USE REQUEST: GANANDA FOOTBALL, INC:
Deb Germain stated that a request has been received from Gananda Football, Inc. for the use of Dolomite Park for the fall football season.
MOTION: Motion by Councilman Maciuska authorizing Gananda Football, Inc. to use Dolomite Park from August 1 through November 13, 2005, provided that there are no conflicts with Walworth Recreation. Seconded by Councilman Keyes. Roll call vote: Supervisor Guelli Aye Councilman Keyes Aye Councilman Maciuska Aye Councilwoman Marini Aye Councilman Yale Aye Motion carried.
ORCHARD VIEW LETTER OF CREDIT:
Supervisor Guelli stated that the Orchard View Letter of Credit has not yet been received. Paul Russell will advise the developer that work is to cease until the Letter of Credit is filed with the Town.
