June 22, 2005 Planning Board Worksession
Chairman Larry Ruth called the meeting to order at 7:34 P.M. Members present were Gene Bavis, Elaine Leasure, Larry Ruth, Pat Stark and Peter Schillaci. Also present were Paul Russell, Phil Williamson, Norm Druschel and Dick Morris.
Peter Schillaci made a motion, seconded by Pat Stark to approve the minutes of 6/13/2005, as presented. Elaine Leasure abstained. Motion carried.
1. Request of Mr. Mark Boss for modification of previously approved site plan located at Lot #1 of the Voelcker Subdivision, 677 Wal-Penfield Road. Property is zoned Hamlet.
Fred Shelley from Kreiling Associates along with the applicant were present and stated the applicant wishes to relocate the house higher on the hill, plus add a pole barn to the site plan. The pole barn will be built concurrently with the construction of the house and used for storage during construction.
Mr. Shelley stated that due to mineral deposits being 11”, a curtain drain would be installed in order to mitigate ground water.
The leach field will be located in the same location as the originally approve site plan.
Mr. Shelley stated the house would be moved approximately 120’ from the previously approved site plan.
Gene Bavis questioned how far the proposed barn was from the property line. Mr. Shelley stated it would be approximately 50’ from the rear lot line. The Board advised the applicant that the barn would not be able to house animals, as it does not meet the minimum setback requirement of 100’. The applicant stated that if he decided to have animals, a separate building would be constructed. The proposed barn will be used for storage.
Paul Russell stated that he did not have a problem with the site plan modification.
Gene Bavis made a motion, seconded by Peter Schillaci to approve the site plan modification subject to the application being in compliance with the Ag & Markets Law and satisfactory review of the Wayne County Planning Board pursuant to 239M of the General Municipal Law.

2. Preliminary plan of Prinzipal Homes, Inc. for 58-lot subdivision to be known as Phase IV & V of Rolford Heights Subdivision located south of Route 441 and north of Gananda Parkway. Property is zoned R.
There was no one present to represent this application.
3. Request of Mr. Charles Paparone, Jr. to extend the site plan approval for lots #3 & 4 of the Carl Scalzo Subdivision located on Plank and Fosdick Roads. Property is zoned RR-1.
Paul Russell stated the certification from Freel Engineering, P.C. regarding the sanitary disposal system is acceptable.
Gene Bavis made a motion, seconded by Pat Stark that the site plan extension for lots # 3 & 4 of the Carl Scalzo Subdivision be granted for 1-year beginning today’s date, subject to the updating, as outlined in the letter dated June 9, 2005 from Frank Spiotta, P.E. of Freel Engineering, P.C.

4. Application of Mr. Ronald Soucy for Waiver of Normal Subdivision requirements to allow applicant to add approximately 15’ of land on the north side of existing parcel. Property is zoned RR-1.
Dick Morris, Attorney for the Town, stated that the conveyance of this piece of land to the applicant by his contiguous neighbor has already been done, without coming before the Board. The approval from the Planning Board should have been granted prior to the conveyance of land. Mr. Soucy was under the impression it was okay, as there had been a change in the Law.
Gene Bavis stated if the County Clerk is recording land transfers without proper documentation, someone from the Town of Walworth should be reminding them that it is not the proper procedure. Dick Morris stated he would contact the County Clerk.
Dick Morris stated that the approval could be done Administratively.
Paul Russell stated that the map must meet town requirements for subdivision, but didn’t have a problem with the Administrative approval.
Peter Schillaci made a motion, seconded by Pat Stark that the application be handled Administratively.
Motion carried.
5. Acknowledge Administrative site plan approval for Dennis O’Brien to include the condition that the Administrative approval is subject to the Parks/Recreation fees.

A one lot or one parcel residential site plan has been presented to be reviewed pertaining to the application of Dennis O’Brien for site plan approval for property located at 4463 County Line Road and subject to the approval of the Code Enforcement Office and the Town Engineer, both of which have approved the application and site plan pursuant to Chapter 151-18A(1) subject to the determination by the Planning Board whether to impose a parks and recreation fee.
In order to impose a parks and recreation fee, the Planning Board must evaluate the present and anticipated future needs for park and recreation facilities in the Town of Walworth based upon projected population growth to which the particular subdivisions will contribute. The population in the Town of Walworth is growing at a fast rate, that over the last several years, the Town has issued numerous building permits per year for new homes, that the master plan of the Town indicates that there is a major demand for new parks, playgrounds, baseball fields, soccer fields and other recreational facilities and that in the immediate neighborhood of the proposed subdivision there is a need for additional facilities. Based upon this need for new parks, playgrounds, baseball fields, soccer fields and other recreational facilities:
I MOVE that the Board find (1) that a proper case exists for requiring the developer to show on the plat a park or parks suitably located for playgrounds or other recreational purposes; and (2) that a suitable park or parks of adequate size cannot be properly located in any such plat or is otherwise not practical. Therefore, a parks and recreation fee, in lieu of construction of a park within said parcel and/or lot, shall be assessed on each lot in an amount established by the Town Board and same shall be paid prior to the issuance of a building permit and said requirement for the payment of parks and recreation fee shall be noted on the plat.
